We are often contacted by family members who are informed they “need” a Power of Attorney to assist a relative that is incapacitated. Unfortunately, if someone is not-legally competent to consent/execute a Power of Attorney, a Guardianship is necessary.

Guardianship is a legal process initiated by a petition filed by an “interested person” requesting to become the guardian of an alleged disabled person. The petition needs to contain two certificates from healthcare professions that have examined the person and will certify that a guardianship is necessary.
